Terms of Service

You must be at least 18 years of age to use TestCart AI. By creating an account, you represent and warrant that:

• You are of legal age in your jurisdiction
• You are capable of entering into binding contracts
• You will comply with all applicable laws and regulations
• You have the authority to bind yourself to these Terms

When you create an account, you agree to:

• Provide accurate, complete, and current information
• Maintain the confidentiality of your password and login credentials
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized access or breach
• Not share your account with third parties or allow others to use your account

TestCart AI reserves the right to suspend or terminate accounts that violate these Terms or engage in prohibited conduct.

Payment and Pricing. Pricing is displayed at study creation. All charges are non-refundable except where required by law. Builders are responsible for all taxes and fees.

Study Conduct. All research studies must comply with GDPR, ESOMAR principles, and applicable privacy laws. Builders will not conduct studies intended to:

• Discriminate based on protected characteristics
• Deceive, mislead, or harm research participants
• Collect data for purposes other than stated market research
• Exploit or manipulate participants

Data Ownership: Builders own the aggregated research findings and insights generated from their studies. Participants' raw biometric and personal data remains the exclusive property of TestCart AI and is strictly protected.

Compensation. Testers are compensated for completed studies as specified in each invitation. Compensation is provided as gift cards, discount codes, or cash via PayPal. Amounts are non-negotiable after study completion.

Conduct During Studies. Testers agree to:

• Engage honestly and naturally with the virtual environment
• Not attempt to manipulate, reverse-engineer, or tamper with the platform
• Not share study links or access codes with third parties
• Report any technical issues or discomfort immediately
• Provide accurate demographic and preference information

Quality and Disqualification. TestCart AI reserves the right to disqualify or exclude Testers who:

• Provide false or misleading information
• Fail to complete studies or provide low-quality responses
• Violate study protocols or code of conduct
• Are flagged by quality assurance mechanisms as suspicious

The Platform, including all virtual environments, 3D models, shelf designs, and technology, is the exclusive intellectual property of TestCart AI. Users are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for authorized purposes.

Users may not:

• Reproduce, distribute, or modify any part of the Platform
• Reverse-engineer, decompile, or attempt to derive source code
• Use the Platform for commercial purposes outside of the authorized scope
• Screen-record or capture VR experiences without explicit written permission

TO THE FULLEST EXTENT PERMITTED BY LAW, TESTCART AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profit, revenue, data, or business opportunity
• Pre-existing medical conditions aggravated by VR use
• Technical failures beyond reasonable control (internet outage, device incompatibility)

IN NO EVENT SHALL TESTCART AI'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER IN THE PRECEDING 12 MONTHS, OR £100, WHICHEVER IS GREATER.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TESTCART AI DISCLAIMS ALL WARRANTIES, INCLUDING:

• Merchantability, fitness for a particular purpose, or non-infringement
• That the Platform will be error-free, secure, or uninterrupted
• That results or findings will be accurate or complete

You agree to indemnify, defend, and hold harmless TestCart AI and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the Platform in violation of these Terms
• Your violation of any applicable law or third-party rights
• Your breach of these Terms
• Claims related to research studies you commissioned or participated in

By You: You may terminate your account at any time by contacting support@testcartai.com. Upon termination, your account will be deactivated and archived data retained per our Privacy Policy.

By TestCart AI: We may terminate or suspend your account immediately if you:

• Violate these Terms or any applicable law
• Engage in fraudulent, deceptive, or harmful conduct
• Fail to pay required fees (Builders)
• Are flagged as a quality or security risk (Testers)

Upon termination, all your rights to use the Platform immediately cease.

These Terms are governed by the laws of the European Union and, where applicable, the laws of the jurisdiction in which TestCart AI Ltd is registered.

Dispute Resolution: Any disputes arising from these Terms or your use of the Platform shall first be subject to good-faith negotiation. If resolution is not achieved within 30 days, disputes shall be resolved through binding arbitration in accordance with the UNCITRAL Arbitration Rules, with one arbitrator and seat of arbitration in London, England.

TestCart AI reserves the right to update these Terms at any time. Material changes will be communicated to Users with at least 30 days' notice. Continued use of the Platform after the effective date of changes constitutes acceptance. The current version is always available at testcart.ai/terms.
